PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & LIMITED CONFIDENTIALITY AGREEMENT

I am the participant and or parent or legal guardian of the listed minor (“Minor”). I give my full consent for the Minor to participate in activities offered by Muhlenberg Taekwon-Do Martial Arts™ LLC, Kido Kwan Martial Arts International™, (collectively, the “Dojang”).

Participation may include, but is not limited to:

• Martial arts classes

• Self-defense classes

• After-school programs

• Personal and fitness training

• Weapons training (including training involving firearms and archery advanced ranks)

• Tournaments and demonstrations

• Travel to and from related activities

(All collectively referred to as the “Program.”)

1. PARENTAL CONSENT & ASSUMPTION OF RISK

I understand that martial arts and related physical activities involve inherent and significant risks, including but not limited to:

• Cuts, bruises, and sprains

• Broken bones

• Head or spinal injuries

• Permanent disability

• Death

• Property damage or loss

I understand these risks may arise from:

• Physical contact and exertion

• Equipment and weapons training

• Facility conditions

• Limited medical availability

• Travel

• The acts or omissions of other participants

On behalf of the Minor and myself, I knowingly and voluntarily assume all risks, both known and unknown, even if arising from the ordinary negligence of the Dojang, except where prohibited by law.

2. RELEASE OF LIABILITY 

To the fullest extent permitted under Indiana and Kentucky law, I, on behalf of myself and or the Minor, hereby:

• Release

• Waive

• Discharge

• Covenant not to sue

the Dojang and its owners, officers, directors, instructors, employees, agents, volunteers, affiliates, successors, and assigns (collectively, the “Released Parties”) from any and all claims arising out of or related to the Minor’s participation in the Program.

This includes claims alleging ordinary negligence of the Released Parties.

This release does NOT apply to gross negligence or willful misconduct where prohibited by law.

3. PARENTAL INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any claim brought by or on behalf of the Minor, including claims that the Minor may later assert after reaching the age of majority, to the fullest extent permitted by law.

I understand this is a material condition of the Minor’s participation.

4. MEDICAL AUTHORIZATION & EMERGENCY CARE

I authorize the Dojang and its representatives to obtain emergency medical treatment for the Minor if I cannot be reached.

I agree to be financially responsible for:

• Emergency care

• Ambulance transport

• Hospitalization

• Medical or dental treatment

• 5. INSURANCE ACKNOWLEDGMENT

  I understand the Dojang does not provide insurance coverage for myself or the Minor, including:

  • Medical

  • Dental

  • Life

  • Liability

  • Personal property

  I am solely responsible for maintaining any desired insurance.

  6. PHOTO AND MEDIA RELEASE

  I grant permission for the Minor’s image, voice, and likeness to be used for lawful promotional purposes, including:

  • Advertising

  • Social media

  • Website content

  • Printed materials

  I understand I may opt out by submitting the Dojang’s written opt-out form.

  ---

  7. LIMITED CONFIDENTIALITY / NON-DISCLOSURE

  On behalf of the Minor and myself, I agree not to publicly disclose proprietary Dojang materials, including:

  • Curriculum details

  • Training methods

  • Internal policies

  • Non-public instructional content

  • Non-public information related to the Dojang or any participants thereof

  This does not restrict:

  • Reporting safety or legal concerns

  • Compliance with law enforcement

  • General discussion of participation

  This provision survives termination of participation.

  8. GOVERNING LAW

  This Agreement shall be governed by and interpreted under the laws of the States of Indiana and Kentucky, without regard to conflict-of-law principles.

  The parties agree that venue for any dispute shall be in a court of competent jurisdiction where the Dojang principally operates.

  9. SEVERABILITY

  If any portion of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  10. CONTINUING EFFECT

  This Agreement remains effective for all current and future participation by the Minor unless revoked in writing and accepted by the Dojang.

  11. ACKNOWLEDGMENT OF UNDERSTANDING

  By signing, I certify that:

  • I am the parent or legal guardian of the Minor

  • I have authority to sign

  • I have read and understand this Agreement

  • I understand I am giving up substantial legal rights on behalf of myself and the Minor

  • I sign voluntarily
